Legal Basis

The EU General Data Protection Regulation, the Data Protection Act 2000 as well as the Data Protection Amendment Act 2018 serve for the right to the protection of personal data. We process your data exclusively on the basis of the legal provisions (GDPR, DPAA 2018, TKG (Telecommunications Act) 2003). In addition, herewith we comply with our information obligations in accordance with the General Data Protection Regulation (Articles 13 and 14). In the process, the declaration is aimed at our existing and previous customers, all interested parties and potential future customers as well as all users of our website and other sources of information.

Specified, Legal Basis, Retention Period and Data Recipients

We require the personal data collected 

  • For the performance of a contract including pre-contractual actions
  • For settlement
  • For communication with you
  • For the assertion of contractual claims
  • For the purposes of customer service and advertising purposes
  • For the purposes for which we ask for your consent.

The data are collected, stored, processed and used for these purposes.

The legal bases for the processing of your personal data are, on the one hand, for the performance of contracts (for example, online purchases), legitimate interests, the fulfilment of our statutory and / or contractual obligations and on the other hand your consent (for example, cookies). The failure to provide information can have various consequences.

We process your personal data (your name, address, telephone number, bank details – for direct debit authorization - and e-mail address) insofar as is necessary for the duration of the entire business relationship (from the initiation, performance and conclusion of a contract) and beyond that in accordance with the statutory retention and documentation obligations that, amongst other things, arise from the Austrian Commercial Code (UGB) and the Federal Fiscal Code (BAO) as well as to the settlement of any potential litigation and continuing warranty and guarantee periods, etc. You will be advised of any other retention periods. For example, we keep your order overviews so that you can check your past purchases and the addresses to which your orders were sent (and, if desired, can repeat order) and so that we can improve the relevance of the products and topics recommended by us.

Within the framework of the operation of our web site, we have commissioned the company Digital Concepts Novak, Winkler OG, that in the course of its activities may gain knowledge of your personal data insofar as these data are necessary for the fulfilment of its respective duties. It has committed itself to us to comply with the applicable data protection regulations. Order processing contracts have been concluded in accordance with Art. 28 GDPR.

The data are passed on to third parties for the performance of contracts: 

  • Personal data such as name, address and telephone number are given to our sales and distribution partners such as, for example, the Austrian post service or to a shipping company.
  • Bank details are given exclusively to our bank for the performance of contracts.

Contact Form

Your entries, including personal data, from our contact form are transmitted to us via our mail server and are further processed and stored by us for the handling of your inquiry. These data are not collected or passed on without your informed consent. Without these data we cannot process your inquiry. Through confirmation in the online form, you give your consent to the passing on to our responsible regional dealer within the EU.

Online Purchasing

We would like to point out that for the purpose of a straightforward purchasing process and later contract processing with online shop operation, the IP data of the subscriber as well as the name, address and telephone number of the purchaser are stored within the scope of cookies. In addition, the following data are also stored by us for the purpose of contract processing: Name, address, telephone number and e-mail address. The data provided by you are needed for the performance of contracts and / or the carrying out of pre-contractual actions. Without these data we cannot enter into a contract with you.

The transmission of the data (name, address, telephone number and bank details) takes place:

  • To the processing bank for the purpose of the debiting of the purchase price
  • To the transport / shipping company commissioned by us for the purpose of the delivery of the goods
  • To our tax advisor for the purpose of the fulfilment of our statutory fiscal obligations. These have committed themselves to us to comply with the applicable data protection regulations.

The data processing takes place on the basis of the statutory provisions of § 96 Paragraph 3 TKG (Telecommunications Act) and of Art. 6 GDPR (in particular, consent and / or necessity for contract performance).

Cookies

Cookies can be used in various ways on our internet platform. Cookies are small pieces of textual information that enable the recognition of the user and the analysis of your use of our web site. The information so generated is transmitted to the server of the provider and is stored there. They serve the purpose of making our overall internet presence more user-friendly, effective and safe. In addition, cookies serve for the measurement of the frequency of page views and for general navigation.

Your IP address is recorded but immediately pseudonymized (for example, by deleting the last 8 bits). Thus, only a rough localization is possible.

The data processing takes place on the basis of the statutory provisions of § 96 Paragraph 3 TKG (telecommunications Act) and of Art. 6 Paragraph 1 lit a (consent) and / or (legitimate interest) of the GDPR.

If subscription to a newsletter is offered, the subscription takes place only with separate consent on your part.

Use of Script Libraries (Google Web Fonts)

In order to correctly and graphically cross-browser present our content, we use the script libraries of Google web fonts (https://www.google.com/webfonts/) on this web site. These web fonts are transmitted for the prevention of multiple downloads in the cache of your browser. If the browser does not support the Google web fonts or prevents access, the contents are displayed in one of the standard fonts available on your device. The calling up of the script libraries automatically triggers connection to the operator of the library. In doing so, it is theoretically possible – currently, however, unclear whether and where applicable, for what purposes – that the operator of these libraries collects data. Use of Google Maps 

This web site uses Google Maps API in order to visually present geographical information. With the use of Google Maps, Google also collects, processes and uses data about the use of the map functions by the visitors. Use of YouTube Videos

We embed YouTube videos on our web site. The operator of the appropriate plug-in is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit a page with the YouTube plug-in, a connection to the server of YouTube is made. In the process, YouTube is informed of which sites you visit. If you have a YouTube account and you are logged in to it, YouTube can associate your surfing behaviour with you personally. This can be prevented by logging out of your YouTube account in advance. When a YouTube video is started, the operator uses cookies to collect information about the user behaviour.

Those who have disabled the storage of cookies for the Google Ads programme need also not reckon with such cookies when watching YouTube videos. YouTube, however, files non-person-related user information in other cookies. If you want to prevent this, you need to block the storage of cookies in the browser.

Consent and Right of Withdrawal

If your consent is needed for the processing of your data, we first process it following your explicit consent.

We never process the data of underage people and are not authorized to do so. With the giving of your consent, you confirm that you are at least 14 years of age or that the consent of your legal representative is present.

Your consent can be withdrawn at any time at the following e-mail address: office@aigner-werkzeuge.at. In such an event, the data about you already stored shall be anonymized and shall subsequently be further used simply for statistical purposes without personal reference. The legality of the processing that has taken place on the basis of the consent up to the point of its withdrawal shall not be affected by the withdrawal of the said consent.

Data Security

Aigner Werkzeuge GmbH implements technical and organizational security measures in order to protect stored personal data against accidental or intentional manipulation, loss or destruction and against access by unauthorized persons. Our security measures are continuously improved in line with technological advances.

Your Rights

At all times you have the right to the disclosure by the responsible person, Grad. Eng. Josef Hochholzer, office@aigner-werkzeuge.at, of the personal data relating to you. Insofar as there is no statutory retention period in place, you have the right to the deletion of these data and to objection to the processing of them.
